Terms and Conditions (T&C)
1. Reservation and booking procedure
With the completed and signed booking form the Client requests a preliminary reservation. The booking will be valid as soon as BerlinLofts confirms the booking. We will confirm the first booking we get for a booking period. With our confirmation you will have a preliminary reservation, which will be valid for 8 days. To finalize the booking we ask you for an advanced payment of 20% of the total cost within 8 days after you got our booking confirmation. With the payment of the advanced charge you have a valid booking. In case the booking request will be within 30 days of your arrival date the total amount will be due immediately to get a valid booking.
2. Payment
The balance of 80% of the total cost needs to be paid not later than 4 weeks prior to your arrival date.
If your booking is within 30 days prior to your arrival date the total amount is due immediately.
Payments need to be done by bank transfer to the account given in the footnote of this document.
3. Cancellation and rebooking
3.1. Cancellation by the Client
The Client can cancel the booking prior to the arrival date. The cancellation has to be done in written form.
The cost of cancellation are given in the table below:
- 46 days prior to arrival date - 25% of the total rental fees
- from 45 days to 31 days prior to the arrival date - 40% of the total rental fees
- from 30 days to 16 days prior to the arrival date - 50% of the total rental fees
- from 15 days to 2 days prior to the arrival date - 80% of the total rental fees
less than two days prior to the arrival date - 100% of the total rental fees.
3.2. Rebooking in favour of a third party
The Client can transfer the booking at any time to third party. The Client and the third party will be liable for the rental cost as a joint debtor.
4. Liability
Other than for death or personal injury caused by the negligence of BerlinLofts, the liability to the Client is limited to the price of the booking. Unless BerlinLofts is liable under the above clause, the Client indemnifies BerlinLofts from and against any and all liability and any claims, proceedings or damages resulting or arising from the booking, event or function, the Client, guests or any outside contractors of the Client. BerlinLofts will not be liable for failure to perform to the extent that the failure is caused by any factor beyond its reasonable control. Clients are responsible for any damage caused to the allocated apartment, furnishings, utensils and equipment in them by any act, omission, default or neglect of the Clients, their guests or sub-contractors and will pay to BerlinLofts on demand the amount required to make good or remedy any such damage.
5. Dogs and other Pets
Pets are not accepted.
6. Cleaning
The basic cleaning has to be done by the Client. This includes the cleaning of the kitchen equipment and objects of utility as well as to empty the garbage cans. The final cleaning will be done by BerlinLofts. Cost of the final cleaning are given on the rental offer.
7. Noise Prevention House Rules
7.1 Each tenant is responsible for ensuring that avoidable noise in the apartment, in the house, the yard and the property does not occur. Volume of radios, TV, CD player and so on have to be put down to reasonable levels which do not disturb other neighbors. Special consideration is the time from 13.00 bis 15.00 clock and in particular between 10pm and 6am in the night rest time.
7.2 Celebrations and parties are not allowed. Under special circumstances by prior arrangement (tenancy agreement before closing) small events can be permitted by the landlord.
8. Place of fulfilment and jurisdiction
Place of fulfilment and jurisdiction is Berlin in Germany.
